BolehPayz Remittance Terms and Conditions
  1. Definition & Interpretation
    1. "Accounts" refers to your BolehPayz e-wallet account, which is created, managed, and operated by WD (WorkerzDirect) in connection with your use of the BolehPayz e-wallet service.

    2. "Applicable Laws" means all relevant laws and regulations governing the use and provision of Remittance Services. This includes, but is not limited to, the Money Services Business Act 2011 (MSBA) and the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2011 (AMLATFPUAA), also known as Act 613.

    3. "Available Balance" denotes the actual amount of funds that are accessible in your account at any given time, subject to the applicable e-money wallet limits.

    4. "Beneficiaries" or "Recipient" refers to the individual you identify in a transaction order as the intended recipient of the funds, which will be disbursed once the transaction is fully processed.

    5. "E-Money" means the electronic monetary value associated with your Account, functioning as a designated payment instrument in accordance with the Financial Services Act 2013.

    6. "Remittance Terms and Conditions" refers to this agreement along with the terms and conditions included herein.

    7. "Sender" refers to you, the Account holder, who initiates a transaction through your Account using the BolehPayz App and authorizes the transfer of funds for WorkerzDirect to process the Transaction.

    8. "Transfer Fee" means the fee charged by WorkerzDirect in connection with BolehPayz acceptance and processing of a Transaction order submitted by you in respect of the Remittance Services.

    9. "Transaction" means a wire transfer of funds using the Remittance Services including without limitation the specific instruction or order you have submitted to WorkerzDirect through BolehPayz Apps to send a remittance of money for the benefit of a Beneficiary through the Remittance Services and the acceptance of such remittance of money by the Beneficiary.

    10. Throughout these Remittance Terms and Conditions, the terms "WorkerzDirect," "we," "us," and "our" refer to WorkerzDirect Sdn Bhd and/or its subsidiaries and affiliates. The terms "you" and "your" refer to the user of the Remittance Services, whether you are acting as the Sender initiating a Transaction via the BolehPayz App or as the Beneficiary receiving the funds.

  2. BolehPayz Remittance
    1. The remittance services ("Services") offered by WorkerzDirect Sdn. Bhd. 201901018960 (1328289-W) ("we", "us", "our" or "WorkerzDirect") through our mobile application, known as BolehPayz, are subject to the terms and conditions outlined herein. This Agreement, inclusive of any associated forms, receipts, acknowledgements, or additional documentation utilized in connection with your utilization of the Services, encompass the entirety of the contractual relationship ("Agreement") between yourself, the individual engaging in the purchase of the Services ("you", "your", "Sender" or "User"), and BolehPayz.

  3. Description of the Services
    1. The Services enable you, as the Sender, to engage in an online transaction whereby you transfer a specified sum of funds (referred to as the "Transfer Amount") through BolehPayz application, to a specified recipient (the "Receiver"). Each such transaction constitutes a "Transfer."

    2. "International Transfer" - A person-to-person transfer directed to a Receiver situated in a foreign jurisdiction. In the case of International Transfers, the Receiver must be an individual (i.e., the Transfer constitutes a person-to-person transfer) with the intention of having the Sender deposit the Transfer Amount into an individual's designated bank account.

    3. Our Services are exclusively available for use within the designated territory of Malaysia only. Further details about the Services can be accessed on the Website or by contacting our Customer Service. The Services, underlying Transfers, and specific aspects thereof may be subject to delays, restrictions, forfeitures, or unavailability due to applicable laws and regulations governing our Services, as well as circumstances and conditions related to your usage of the Services.

    4. We will disclose information regarding the Transfer, including the available balance, as well as other relevant details pertaining to you and/or the utilization of our Services, to the relevant legal or regulatory authorities, governing bodies, or entities as required or deemed appropriate in accordance with the applicable laws and regulations governing our Services.

  4. Eligibility
    1. User must be at least 18 years of age and legally permitted under the applicable laws and regulations.

    2. User must possess a valid Identification Card "ID" such as MyKad, MyPR and MyKas (for Malaysian), and passport (for foreign/migrant worker).

  5. Use of the Services
    1. User are permitted to use the Services solely for applicable law purposes and are prohibited from using the Services for: -

      1. gambling activities.

      2. Transfer on behalf of a third party.

      3. To send funds to individuals whom you do not have prior knowledge of.

    2. User must take all necessary measures to protect their password, including changing it regularly. They must keep their password confidential and refrain from disclosing it to third party. The user is responsible for any transactions or activities that conducted through their account, including unauthorized use.

    3. The User affirms that all details and information provided to facilitate approval and registration for Services are truthful, precise, up-to-date, comprehensive, and not deceptive. The User agrees to promptly inform WorkerzDirect of any changes to the User's provided personal details, in writing, by utilizing the BolehPayz e-form in apps and website, or by sending an email to [email protected].

  6. Updates, Modifications and Availability
    1. WorkerzDirect may, from time to time, enhance or modify the features and functions of the BolehPayz App, website, and/or Services, and reserves the right to carry out any updates, upgrades, changes, or improvements as it sees appropriate. Users acknowledge that these changes may cause temporary disruptions, alterations, delays, malfunctions, or even the suspension of the App, Site, and/or Services or any of their features. Accordingly, Users agree and accept that WorkerzDirect bears no liability or responsibility for any such disruptions, changes, or discontinuation.

  7. Transfer Information
    1. A Transfer will generally be accessible for collection by the Receiver within the operating hours of the designated Correspondent. However, for transfer to a bank account, WorkerzDirect cannot provide a guarantee regarding the timing of crediting into the receiver account. Delay in Transfers may arise due to factors such as availability, conditions in the destination country, or regulatory requirements.

    2. Fund sent to an account will be credited to the bank account within three business days after the transaction date. A "Business Day" means a day when the Correspondent providing the service is open for business, except for weekends and national holidays.

    3. Any requests for transaction received by WorkerzDirect after 5.00pm on a Business Day will be processed on the subsequent Business Day.

  8. Prohibited Actions and Limitations
    1. WorkerzDirect reserves the right, without prior notice (except where mandated by law) and without assuming any liability towards you, to decline any instruction for a Transfer, suspend or deactivate your User Account (as defined below), halt or reverse any Transfer, or otherwise suspend or terminate access to, or decline to provide, any Services at its sole discretion, including but not limited to such actions: -

      1. If you attempt to initiate a Transfer that is not yours, lacks sufficient available funds or credit, has expired, or if the payment is declined or the payment is blocked or reversed for any reason.

      2. If we have reason to suspect that any Transfer may not be authorized by you.

      3. If any Transfer involves funds that are subject to a hold, dispute, or legal process preventing withdrawal from the relevant bank account or credit card account.

      4. If you have violated any term or condition of this Agreement, or if any representation or warranty made by you under this Agreement is found to be false.

      5. If we determine that your User Account has been inactive.

      6. If, in our sole discretion, we believe that you are directly or indirectly using, or attempting to use, the Services for any unlawful or improper purpose.

      7. If you provide incomplete, incorrect, or false information about yourself and the Receiver.

      8. If you attempt to manipulate, hack, modify, or otherwise compromise the security or functionality of the BolehPayz application or the Services.

  9. Transaction Fee and Foreign Exchange
    1. For each remittance transaction conducted via the BolehPayz application, the User is accountable for a Transaction Fee imposed by WorkerzDirect. The relevant Transfer Fee and foreign exchange rate will be established according to the most recent rate published by WorkerzDirect periodically on the WorkerzDirect website and BolehPayz application. The User recognizes that WorkerzDirect retains complete discretion in setting the Transaction Fee and relevant foreign exchange rate.

    2. Our remittance services apply a transaction fee based on the designated recipient country. For full details of the applicable fees and exchange rates, please refer to the rate table available within your BolehPayz app.

    3. The fixed fee for transferring fund to the following countries are as follows:

    4. WD reserves the right to revise the fees, charges, and exchange rates from time to time in line with market conditions, operational costs, or regulatory requirements. Any revisions will be communicated through official channels, including updates within the BolehPayz app or other appropriate means, prior to taking effect. Users are encouraged to review the latest fee schedule regularly before initiating transactions.

  10. Refund Information
    1. If the remittance transaction rejected or void in initial phases and yet to be process in accordance with our refund policy, we will reimburse you the original payment amount including the Transaction Fee.

    2. To initiate a refund, customers must submit their requests through the BolehPayz e-Form on the app or website, or by sending an email to [email protected]. Alternatively, customers can contact our Customer Service at 03-50332458 for assistance with the refund process.

  11. Data Protection
    1. Please note our Data Protection policy, which can be accessed from our Correspondents and prominently displayed at each of our Correspondents' business premises. We specifically draw attention to the provisions regarding the transfer of your personal data outside of Malaysia.

    2. We may gather personal data, including but not limited to your name, email address, phone number, and physical address, either when voluntarily submitted by you or when you utilize our services. The collected data is utilized to deliver and enhance our services, establish communication with you, facilitate transactions, and fulfill your specific requests.

  12. Regulatory
    1. The User acknowledges that the BolehPayz Services must comply with the relevant rules, guidelines, and requirements set forth by the Central Bank of Malaysia or Bank Negara Malaysia ("BNM").

  13. Complaints
    1. If you have a complaint regarding the Service, please contact WorkerzDirect's Customer Services by telephone, mail, or email as specified in Clause 19.

  14. Our Responsibility, Limitations, and Warranty Disclaimer
    1. In the event that WorkerzDirect fails to complete a Transfer on time or in the correct amount despite receiving a fully paid, timely, complete, and accurate Transfer request in accordance with this Agreement, WorkerzDirect's liability will be limited to your directly caused actual damages, as mandated by relevant legal requirements.

    2. Unless mandated by law, your exclusive recourse against WorkerzDirect shall be limited to the reimbursement of the Transfer Amount alongside any refundable Transfer Fees levied by WorkerzDirect. No other remedies are available to you, including any for incidental, indirect, special, or consequential damages. These limitations apply regardless of the cause of your claim, including negligence or other fault on the part of WorkerzDirect. WorkerzDirect are not responsible for the actions or omissions of issuers, carriers, or any of their service providers.

  15. Right of Third Parties
    1. WorkerzDirect may at any time assign, transfer, charge, or otherwise dispose of all or a portion of these Terms and Conditions, as well as any of its obligations, rights, or privileges to any third parties, but will make certain to take the necessary precautions to ensure that by doing so will not jeopardise any of User's rights under these Terms and Conditions.

  16. Severability
    1. If any provision (or part thereof) of the agreement (including the Terms and Conditions) is deemed invalid, illegal, or unenforceable by any court or competent authority, such provision or part-provision shall be considered as not forming part of the agreement to the extent necessary. The validity and enforceability of the remaining provisions of the agreement shall remain unaffected.

  17. Governing Law
    1. The agreement shall be interpreted in accordance with Malaysian law, and any disputes arising from the agreement shall be exclusively subject to the jurisdiction of the Malaysian courts.

  18. Language
    1. The Terms are also available in the Bahasa Indonesia and others if applicable. In the event of inconsistency, conflict, ambiguity, or discrepancy between the English version or any other language version, English version of Terms shall prevail.

  20. Amendments
    1. WorkerzDirect reserves the right to modify, adjust, or revise any or all of these Terms and Conditions at its discretion. Such changes will be communicated through its official mobile application or System. By continuing to use the Services provided by WorkerzDirect following the posting of such modifications, the User implicitly consents to be bound by them. The User waives any claims against WorkerzDirect for any losses incurred as a result of such modifications, adjustments, or revisions.
